Offer made by employers or unions in collective bargaining negotiations designed to assist them in finding mutually satisfactory answers to problems. Under the Wagner Act the National Labor Relations Board gave weight to the employer's counter-proposals of offers when determining whether the employer was bargaining in good faith. Concessions made by the employer were one of the indicia of good faith. Under the Taft-Hartley Act (Section 8 (d) collective bargaining is defined so that there is no obligation on the part of the employer or union "... to agree to a proposal or require the marking of a concession".
