  Définition

  A substantial sum paid by a borrower at the time of issuance of a standby commitment letter, as a charge for the lender's risk and responsibility in committing to the loan.

  Note :

  The standby fee is forfeited if the loan is not closed within a specified time. Most courts uphold the forfeiture of the standby fee as a lawful damage provision and not as an unlawful penalty.
