Depressed area in recent legislation have been defined as certain geographic communities in which the number of unemployed has gone beyond a certain percentage, generally substantially above the average for the country.

Under Sections 5 and 5(b) of the Area Redevelopment Act of 1961, areas were designated by the Area Redevelopment Administrator as eligible for assistance according to the following criteria : industrial areas - (1) unemployment in the area averaged at least 6 percent during the qualifying period; and (2)8a) 50 percent above the national average for three of the preceding four calendar years, or (b) 75 percent above the national average for two of the three preceding calendar years, or (c) 100 percent above the national average for one of the preceding two calendar years. Rural and Smaller Urban Areas - "... the number of low income farm families in the various rural areas... the relationship of the income levels of the families in each such area to the general levels of the families in each such area to the general levels of income in the United States... the availability of manpower in each such area for supplemental unemployment... the extent of migration out of the area... and the extent to which "rural development" protects have previously been located in any such area under programs administered by the Department of Agriculture..." By January 1962, 129 labor market areas, most of which had a minimum labor force of 15,000 in 1960 that included at least 8,000 monagricultural workers, were designated as eligible to receive ARA assistance under Section 5 of the Act. These are sometimes referred to as "5 areas" because they were designated as eligible for assistance under Section 5 of the Act. Another 657 counties, most of which had a labor force of less than 15,000 in 1960 and containing either small urban centers or were predominantly rural, were designated "5(b) areas" eligible for assistance under the Act. Sar A. Levitan has suggested that a depressed area is one marked by general economic stagnation and that "a high rate of chronic unemployment is only one of many socioeconomic characteristics signaling distress in an area. A stagnating population [out-migration, particularly of the young and the better educated], deterioration in the quality of available labor resources [low educational attainment among the population and a high rate of unskilled labor], declining labor-force participation rates, low wages and income, inadequate investment in capital outlays, and substandard housing are associated with chronic labor-surplus areas." The Public Works and Economic Development Act of 1965 set forth criteria similar to Section 5 of the Area Redevelopment Act in establishing "redevelopment areas" eligible for federal assistance.
